These General Conditions of Sale (GTC) govern all sales made by the company IZI COSMETICS, whose registered office is located at 59 rue ponchieu, 75008 Paris, registered in the Register of Commerce and Companies under the number 832 463 491, email: Izicosmeticsfr@gmail.com. They apply to all orders placed via www.izicosmetics.fr, whether for wholesale products, samples, or services.

It is expressly agreed that any order implies the full acceptance of these Terms and Conditions, which prevail over any previous document or agreement, unless expressly and in writing accepted by our company.

Article 1: REALIZATION OF ORDERS AND INDUSTRIALITY

1.1. Order conditions

Any order, whether made by email, WhatsApp, private message on social networks, or any other medium, is the responsibility of the customer. The order confirmation by our company comes by any written means (email, message, estimate). The order will be considered firm and final upon receipt of the written agreement, subject to availability.

1.2. Non-reimbursability and waiver of the right of withdrawal

Samples, cosmetic products in bulk, and services are not refundable once the order has been confirmed, processed or processed. By placing an order, the customer expressly waives his right of withdrawal, in accordance with article L.221-28 of the Consumer Code, in particular for customized products, wholesale, or in the provision of service.

1.3. Processing of orders

Wholesale orders are processed within an average of 15 working days, excluding weekends and holidays. Delivery times are indicative; any delay will not give rise to compensation or penalty, due in particular to factors related to the customer's country of residence, the delivery solution chosen or cases of force majeure.

Sample orders are usually processed within 10 working days, with delivery estimated at 5 working days. These delays may vary depending on the customer's country of residence, the location of the delivery location, and the delivery formula chosen.

1.4. Delivery

Delivery is by courier or postal service according to the customer's choice when ordering. IZI COSMETICS shall not be liable for any delay, loss or damage caused by circumstances beyond our control, in particular in the event of force majeure, strike or disruption of postal or transport services.

Article 2: PAYMENT PRICES AND MODALITIES

2.1. Rates

Prices are indicated in euros, with or without VAT depending on the nature of the customer (individual or professional). For international orders, customs taxes or duties may apply at the customer's destination, and IZI COSMETICS declines any liability in this regard.

2.2. Methods of payment

Payments are made via credit card, bank transfer or any other means chosen by IZI COSMETICS. Payment shall be deemed to be made as soon as the transaction is actually registered. No refund is provided for a deposit paid, unless our company expressly agrees.

2.3. Deposit and balance

In case of deposit, the deposit is non-refundable and the balance must be paid in full upon confirmation of order or before shipment. In case of partial payment, the order will only be processed after receipt of the total amount or deposit.

Article 3: PRODUCTS, SAMPLES AND BENEFITS

3.1. Wholesale

Wholesale orders are processed within a standard 15 business day time frame. Once the command is validated, it will no longer be subject to cancellation, modification or withdrawal. Delivery is made according to the chosen method, at the address indicated by the customer.

3.2. Samples

Cosmetic samples are supplied for information or testing purposes only, and their order does not qualify for reimbursement. The processing time is on average 10 working days, with delivery within 5 working days. Any delay in delivery will not be liable to IZI COSMETICS.

3.3. Wholesale orders, minimum and errors

Wholesale products are subject to a minimum of 30 pieces per reference. Orders below this minimum cannot be accepted unless our company has previously agreed in writing.

For customers wishing to test a product in large format without reaching the minimum, it is possible to order only as samples. In this case, if the order concerns only one or more products in large format to test, the company can process the order by sending the customer an amount in samples equivalent to the amount paid, or higher if the customer wishes to test several products or formats.

In case of error or partial order, the customer will either have to complete his order to reach the minimum required (e.g. by adding other products wholesale or buying additional samples), or pay the difference to meet the minimum.

Wholesale or sample products are not refundable. The company reserves the right to process these orders at its sole discretion, in particular to ensure fair service to all its customers.

Article 4: RIGHT OF RETRACTATION AND RETIREMENT

4.1. Right of withdrawal

In accordance with the legislation in force, the professional or private customer expressly waives any right of withdrawal for wholesale orders, customized products, services or samples. No withdrawal may be exercised once the order has been confirmed, processed or processed.

4.2. Return and refund

Wholesale cosmetic products, samples, or services are non-refundable. Any return of products or refund application will be automatically refused, unless there is a proven defect or non-compliance recognized by our company, in accordance with Article 6.

4.3. Status of returned products

The products must be returned in their original condition, without use, in their original packaging, and with all accessories. Any product damaged, used or incomplete shall not give rise to any refund or refund.

4.4. Return costs

Return costs are borne by the customer, unless the claim is justified by a proven defect or non-compliance. In case of accepted return, the refund will be made within 3 to 5 working days via the initial payment method, less any return costs.

Article 5: LIABILITY AND LIMITATION OF GUARANTEE

5.1. Responsibility of IZI COSMETICS

Our company cannot be held liable for any delay, loss or damage caused by a case of force majeure, an error in delivery attributable to the customer, or a misuse of the product. The liability of IZI COSMETICS is limited to the amount of the order.

5.2. Guarantee

Cosmetic products in bulk or in samples are supplied « In the state ». No product is guaranteed against any defects, degradation or use at risk. The liability of IZI COSMETICS cannot under any circumstances cover indirect damage, such as loss of chance, loss of exploitation, or moral damage.

Article 6: Data Protection and Applicable Law

6.1. Personal data

Personal data collected during the order are processed in accordance with our Privacy Policy, which is available on our website.

6.2. Applicable law and litigation

These Terms and Conditions are governed by French law. In the event of a dispute, the customer will address our company as a priority for an amicable solution. Otherwise, the exclusive jurisdiction of the French courts will be retained.

Article 7 : AMENDMENTS TO THE GTC

We reserve the right to amend these Terms and Conditions at any time without notice. The version applicable to any order is that in force at the time of validation of the order.

ARTICLE 8: ORDER ERRORS AND SAMPLES

8.1. Wholesale and minimum order orders

Wholesale products are subject to a minimum order of 30 pieces per reference. Any order below this minimum cannot be accepted for this reference, unless specific and written agreement of our company.

8.2. Sample control and testing

Some customers can order products in large format to test the product without reaching the minimum order required for a wholesale order. In this case, if the order concerns only one or a few products in large format to test, the company reserves the right to process the order by sending the customer an amount in samples equivalent to the amount paid by the customer, or a higher amount if the customer wishes to test several products or formats.

8.3. Procedures in case of partial order

If a customer orders a wholesale product, e.g. 5 units, and wishes to test or complete his order, he must either:

complete your order to reach a minimum of 30 pieces (e.g. by adding other products wholesale or buying additional samples), or

pay the difference to complete the order up to the minimum required, if possible.

8.4. Non-repayment

Products purchased in bulk or in samples are not refundable. If the company decides to send samples as compensation for the amount paid, they will be sent as free samples and will not be subject to any claim or refund.
